By accessing or using CloutNest ("the Platform"), operated at cloutnest.co.ke, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Platform. These Terms apply to all visitors, registered users, and anyone who places an order or otherwise accesses our services.
CloutNest is a digital marketing and social media growth platform that allows users to purchase engagement services (such as followers, likes, views, and related metrics) for supported social media networks. We act as a reseller and fulfillment platform; delivery is subject to the availability and policies of the relevant social network.
You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use CloutNest. By registering, you represent and warrant that:
To place orders you must create an account. You agree to provide truthful registration information and to update it as necessary to keep it accurate. You must notify us immediately at support@cloutnest.co.ke if you suspect unauthorised use of your account. CloutNest is not liable for any loss resulting from your failure to safeguard your credentials.
All prices are displayed in the currency shown on the Platform and are inclusive of applicable fees. By placing an order you authorise us to charge the stated amount to your chosen payment method. Orders begin processing immediately upon successful payment; cancellation is only possible before processing starts (see our Refund Policy). We reserve the right to cancel or refuse any order at our discretion.

We may suspend or permanently terminate your account if we determine, in our sole discretion, that you have violated these terms.
We make reasonable efforts to fulfil orders within the estimated timeframes displayed at the time of purchase. However, delivery times are estimates and may vary due to factors outside our control, including third-party platform changes, network conditions, or high order volumes. CloutNest does not guarantee any specific business outcome, reach, or revenue as a result of using our services. Natural fluctuations in engagement metrics after delivery are outside our control and are not grounds for a refund.
All content on the Platform — including the CloutNest name, logo, design, text, graphics, and software — is owned by or licensed to CloutNest and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Platform without our prior written permission.
The Platform and all services are provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components.
To the fullest extent permitted by applicable law, CloutNest and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or other intangible losses — arising out of or in connection with your use of (or inability to use) the Platform or our services, even if we have been advised of the possibility of such damages. Our total aggregate liability to you for any claim shall not exceed the amount you paid to CloutNest in the 30 days preceding the event giving rise to the claim.
You agree to indemnify, defend, and hold harmless CloutNest and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your infringement of any third-party rights.
The Platform may contain links to third-party websites or integrate with third-party services (e.g., payment processors, social networks). These links are provided for convenience only. CloutNest has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party sites or services.
We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, all provisions of these Terms that by their nature should survive (including intellectual property, disclaimers, indemnification, and limitation of liability) will continue to apply. You may close your account at any time by contacting support@cloutnest.co.ke.
These Terms are governed by and construed in accordance with the laws of Kenya, without regard to its conflict-of-law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Nairobi, Kenya.
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you by email. Your continued use of CloutNest after the updated Terms take effect constitutes your acceptance of the revised Terms.
